The Lord President appoints Lord Ericht as Regulatory Judge

Dec 16, 2025

Lord Pentland, Lord President of the Court of Session, has announced the appointment of Lord Ericht as Regulatory Judge.

Under the Regulation of Legal Services (Scotland) Act 2025, the Lord President has been given new functions in his role as ultimate regulator of the legal profession in Scotland.  Lord Ericht has been appointed to provide support to the Lord President on regulatory matters and consider the detail of the work needed to implement the Act. The Lord President will retain decision making and oversight of all regulatory matters.

Lord Ericht is a judge of the Inner House of the Court of Session with considerable experience of regulatory, competition and consumer issues.  He is a former Chairman of the UK Competition Appeal Tribunal.

On 15 December, Lord Ericht chaired a meeting at the Court of Session of senior representatives of the Association of Construction Attorneys, Faculty of Advocates, Law Society of Scotland, Scottish Legal Complaints Commission, Scottish Legal Complaints Commission Consumer Panel and Scottish Solicitors’ Discipline Tribunal to discuss implementation of the 2025 Act.

The Lord President said:

“As ultimate regulator of the legal profession, I welcome that the regulatory authorities took the time to come together at yesterday’s meeting.  I encourage them to continue to work co-operatively with each other to ensure that the new regulatory landscape under the Act achieves its objectives, which include promoting the interests of consumers and promoting a strong and independent legal profession.”
