Preliminary Hearings Bench Book updated

Practitioners may wish to note that the Preliminary Hearings Bench Book has been updated.


The Bench Book was first published on 22 July 2020 and was previously updated in November 2020. The latest changes, made on 23 February, are as follows:

  • In paragraph 1.1.3, the reference to the High Court of Justiciary Direction No. 2 of 2020 has been updated to read “High Court of Justiciary Direction No. 1 of 2021.”
  • Paragraphs 9.2.3, 9.2.5, 9.3.1, 9.3.4, 9.5, 9.7.2.2, 9.7.3 have all been updated to include references to recent but embargoed case law; that is opinions which are not yet published on the scotcourts website. For public readers of this Bench Book, a hyperlink to the opinions will be made available on this page in the next update of the Bench Book once the opinions have been published on the scotcourts website.

We recommend that users consult the User Guide (found at pages 3 and 4 of the Bench Book) before using the Bench Book.

Practitioners can access the updated Bench Book here on the Judiciary of Scotland website Judicial Institute Publications page.  It is available as a PDF and can be accessed online, downloaded for use offline or printed if necessary.
