SENTENCING STATEMENTS

 

A judge may decide to publish a statement after passing sentence on an offender in cases where there is particular public interest; where a case has legal significance; or where providing the reasons for the decision might assist public understanding.

Please note that statements may include graphic details of offences when it is necessary to fully explain the reasons behind a sentencing decision.

Once charges are spent, any statement in relation to them is removed and cannot be provided or acknowledged. Statements published before the launch of the website may be available on request. Please email judicialcomms@scotcourts.gov.uk

The independence of the judiciary is essential to safeguard people’s rights under law - enabling judges to make decisions impartially based solely on evidence and law, without interference or influence from the government or politicians.

When deciding a sentence, a judge must deal with the offence that the offender has been convicted of, taking into account the unique circumstances of each particular case. The judge will carefully consider the facts that are presented to the Court by both the prosecution and by the defence.

HMA v Keith Rizzo

Apr 6, 2020

At the High Court in Glasgow today, Lady Rae sentenced Keith Rizzo to life imprisonment after the offender was convicted of murdering his girlfriend. The punishment part (the minimum time the offender must serve in prison before being considered by the Parole Board for Scotland for possible release on a life licence with conditions), was set at 22 years. If still considered a serious risk after the punishment part has expired, the offender will not be released.

At the High Court in Glasgow today Lady Stacey sentenced Keith Farquharson to imprisonment for life after the offender was found guilty of murdering his wife.

HMA v Jason Watson

Mar 13, 2020

At Glasgow High Court on Wednesday 12 March 2020 Judge Cubie sentenced Jason Watson to 3 years 4 months imprisonment and a supervised release order for a period of 12 months, the accused was also disqualified from driving for 68 months, after he was found guilty of assaulting two men and their dogs with a car.

HMA v James Martin

Mar 12, 2020

At the High Court in Edinburgh today (12 March 2020) Lord Boyd of Duncansby imposed an Order for Lifelong Restriction on James Martin after the offender admitted attempting to murder his mother. This is a sentence of imprisonment for an indefinite time with release only if the Parole Board is satisfied that the offender would no longer endanger public safety. The minimum time the offender must serve before the Parole Board can consider release is 4 years.
